Cockroach heaven; imposition of expired lease cove

The apartment management is requiring a 60-day notification of intent to vacate their premises (as specified in the lease I originally signed). However, my lease agreement expired on July 26, 2006. Since then, I have been living at the apartment complex on a month-to-month basis. I gave notice of intent to vacate on October 12, 2006. Their attempt to require a 60-day notification is not valid, based on the fact that my lease had expired prior to my giving notice that I was vacating the premesis. I should only be required to give 30 days notice, instead of 60 days. In addition, my apartment unit was badly infested with cockroaches and other pests. There was no attempt to notify me of this condition until after I signed the lease. |
